These Terms of Service ("Terms") govern your use of resonance-book.com (the "Site"), operated by Ron K. Miller doing business as Open Channel Press ("we," "us," or "our"). By accessing the Site, browsing its content, signing up for launch notifications, or placing an order, you agree to these Terms. If you do not agree, do not use the Site.
You may use the Site for personal, non-commercial purposes. You agree not to use the Site in any manner that could damage, disable, overburden, or impair the Site, or interfere with any other party's use of the Site. You agree not to attempt to gain unauthorized access to any portion of the Site, including the password-protected manuscript area, accounts, computer systems, or networks connected to the Site.
All content on the Site, including the text of Resonance: Why Music Moves Us, excerpts, design, photography, illustrations, code, and all related materials, is owned by Ron K. Miller or licensed to Open Channel Press, and is protected by United States and international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Site, except as follows:
Quotation from Resonance: Why Music Moves Us in reviews, academic work, or journalism is welcome under standard fair use. Inquiries about other uses should be directed to the contact email at the bottom of this page.
Orders for books and other merchandise placed on the Site are subject to acceptance and availability. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud, pricing errors, or unavailability of stock.
Payments are processed by Stripe. By providing payment information, you authorize Stripe to charge the payment method you provide for the amount shown at checkout, including any applicable sales tax and shipping. We do not store full payment card numbers on our servers.
All prices are in U.S. dollars and are subject to change without notice. Sales tax is calculated and added at checkout in jurisdictions where we are registered to collect it. You are responsible for any duties, taxes, or fees imposed by your local jurisdiction on imports.
Pre-order pricing is locked at the price displayed when you place the order. Pre-order ebooks are delivered on the announced release date. Pre-order signed hardcovers are charged at the time of order and ship as soon as stock is available, typically within fourteen days of the announced release date.
Signed hardcover editions purchased directly through the Site ship via USPS or another carrier of our choice from Arkansas, United States. Estimated delivery times displayed at checkout are estimates, not guarantees, and depend on carrier performance and your location.
Trade editions purchased through Amazon, IngramSpark partners, or other retailers ship under those retailers' shipping policies, not ours.
Risk of loss and title for items purchased directly pass to you upon our delivery to the carrier. If a shipment is damaged in transit, see Section 5.
All sales of signed hardcover editions are final. Signed editions are personalized and cannot be resold, so refunds and returns are not accepted except as described below.
If your direct-purchase order arrives damaged or defective, notify us at media@resonance-book.com within fourteen days of delivery. Include your order number and photographs of the damage. We will replace the item at no charge if stock is available, or issue a refund if replacement is not possible.
If your direct-purchase order does not arrive within thirty days of the shipping confirmation, contact us within fourteen days of that thirty-day window. We will work with the carrier to locate the shipment and either replace the order or refund it.
Refunds, when issued, are credited to the original payment method within seven business days. You will be notified by email when the refund is processed.
For purchases made through Amazon, Barnes & Noble, IngramSpark distribution partners, or any other retailer, refunds and returns are handled under that retailer's policy. We cannot process refunds for orders we did not fulfill.
When you submit information through the contact form, sign up for launch notifications, or otherwise communicate with us through the Site, you grant us a non-exclusive, royalty-free license to use that submission for the purpose of responding to you, fulfilling your request, and improving the Site. We will not publish any submission containing your personal information without your permission.
Do not submit any content that is unlawful, defamatory, threatening, harassing, obscene, infringing on intellectual property rights, or otherwise objectionable. We may remove or refuse to act on any submission at our discretion.
The Site and all content available on it are provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
Resonance: Why Music Moves Us draws on neuroscience, acoustic physics, evolutionary biology, and philosophy of perception. It is a work of narrative nonfiction. It is not medical advice. Any reference to therapeutic applications of music is descriptive of published research, not a recommendation for treatment of any condition. Consult a qualified healthcare provider for medical questions.
To the fullest extent permitted by law, in no event will Ron K. Miller, Open Channel Press, or any of our affiliates, employees, agents, or service providers be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or any content on it, including but not limited to lost profits, lost data, or business interruption.
Our total liability to you for any claim arising out of or related to the Site or any purchase made through it will not exceed the amount you paid us in the twelve months preceding the claim, or one hundred U.S. dollars, whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to defend, indemnify, and hold harmless Ron K. Miller and Open Channel Press from any claim, liability, damage, loss, or expense (including reasonable legal fees) arising out of or in any way connected with your violation of these Terms or your misuse of the Site.
These Terms are governed by the laws of the State of Arkansas, United States, without regard to its conflict-of-law principles. Any dispute arising out of or related to these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Washington County, Arkansas, and you consent to the personal jurisdiction of those courts.
We may revise these Terms at any time. The "Effective" date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. If a change materially affects your rights, we will provide notice on the Site for a reasonable period.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms otherwise remain in full force and effect.
